1. Introduction

These Terms and Conditions ("Terms") govern access to, and use of the website, products, subscriptions, software, reports, and services provided by Mirsv IO (Pty) Ltd, trading as mirsv.io ("Mirsv", "we", "our", or "us").

Mirsv is a South African cybersecurity company that leverages artificial intelligence, automation workflows, commercial threat intelligence, and human expertise to identify, assess, score, and mitigate phishing, fraud, impersonation, social engineering, and related cyber threats.

By accessing or using mirsv.io services, you agree to these Terms.

If you do not agree with these Terms, you should discontinue use of the services.

2. Eligibility

You must:

  • Be at least eighteen (18) years old;
  • Have legal capacity to enter into binding agreements;
  • Use the services in accordance with applicable laws;
  • Provide accurate and complete information when creating an account.

Where services are used on behalf of an organisation, the user represents that they have authority to bind that organisation to these Terms.

3. Services

Mirsv provides cybersecurity services, which may include:

  • Phishing detection;
  • Fraud detection;
  • Risk scoring;
  • Threat intelligence;
  • Security scanning;
  • AI-assisted analysis;
  • Automated mitigation workflows;
  • Security reporting;
  • Subscription services.

Mirsv may update or improve its services from time to time.

4. No Guarantee of Security

Cybersecurity risks continually evolve. No cybersecurity solution can guarantee complete protection from all threats. Mirsv provides:

  • Security analysis;
  • Risk scores;
  • Recommendations;
  • Threat intelligence;
  • Mitigation workflows.

These services are intended to reduce cyber risk and support informed decision-making.

Users remain responsible for their own security decisions, controls, and operational practices.

5. Risk Scores and Threat Assessments

Mirsv uses artificial intelligence, automation, commercial threat intelligence, internal intelligence systems, and human expertise to generate:

  • Risk scores;
  • Threat classifications;
  • Security recommendations;
  • Fraud indicators.

Risk scores and threat assessments are intended to support decision-making and should not be interpreted as guarantees.

6. User Responsibilities

Users are responsible for:

  • Maintaining account security;
  • Protecting passwords and authentication credentials;
  • Providing accurate information;
  • Monitoring account activity;
  • Implementing appropriate security controls;
  • Reviewing recommendations and reports before acting.

Users should notify Mirsv immediately if they suspect unauthorized access or misuse.

7. Acceptable Use

Users may not use Mirsv services to:

  • Engage in unlawful activity;
  • Conduct unauthorized access;
  • Distribute malware;
  • Deploy ransomware;
  • Conduct phishing attacks;
  • Interfere with systems or networks;
  • Abuse or disrupt the availability of services;
  • Reverse engineer proprietary technology;
  • Circumvent security measures.

Failure to comply with these Terms may result in suspension or termination of access.

8. User Accounts

Users are responsible for maintaining the confidentiality of their credentials. Passwords are encrypted and are not stored in plain text.

Users are responsible for activities occurring under their accounts.

9. Subscription Services

Mirsv may provide:

  • Free services;
  • Monthly subscriptions;
  • Business subscriptions;
  • Enterprise services.

Subscription features and pricing are published on the mirsv.io website or provided through separate agreements.

10. Payments

Subscription fees are billed in advance. Users are responsible for ensuring that payment information remains accurate.

Failure to make payment may result in suspension of access to paid services. Payment processing may be handled by trusted third-party payment providers.

11. Intellectual Property

All intellectual property rights relating to Mirsv services remain the property of Mirsv IO (Pty) Ltd. This includes:

  • Software;
  • Algorithms;
  • AI models;
  • Automation workflows;
  • Reports;
  • Threat intelligence;
  • Branding;
  • Documentation;
  • Logos;
  • Website content.

Use of the services does not transfer ownership rights to users.

12. Confidentiality

Users agree not to disclose proprietary or confidential information obtained through use of Mirsv services.

Confidentiality obligations continue after termination of access.

13. Privacy

Mirsv processes personal information in accordance with its Privacy Policy and applicable privacy laws.

Mirsv does not sell personal information.

14. Third-Party Services

Mirsv relies on third-party infrastructure and service providers, including:

  • Hosting providers;
  • Analytics providers;
  • Payment processors;
  • Threat intelligence providers.

Mirsv is not responsible for disruptions caused by third-party services outside its control.

15. Availability

Mirsv aims to maintain reliable services. Temporary interruptions may occur due to:

  • Maintenance activities;
  • Infrastructure failures;
  • Security incidents;
  • Internet outages;
  • Events beyond reasonable control.

16. Limitation of Liability

To the maximum extent permitted by law, Mirsv shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Mirsv's total liability arising from the use of its services shall not exceed the amount paid by the customer to Mirsv during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

17. Indemnity

Users agree to indemnify and hold harmless Mirsv, its directors, employees, contractors, and affiliates against claims arising from:

  • Violation of these Terms;
  • Misuse of services;
  • Violation of applicable laws;
  • Infringement of third-party rights.

18. Suspension and Termination

Mirsv may suspend or terminate access where:

  • Fraud is identified;
  • Security risks are detected;
  • These Terms are violated;
  • Payment obligations are not met.

Termination does not affect rights or obligations that arose before termination.

19. Compliance with Laws

Users are responsible for ensuring that their use of Mirsv services complies with applicable laws and regulations.

20. Force Majeure

Mirsv shall not be responsible for delays or failures caused by events beyond its reasonable control, including:

  • Natural disasters;
  • Power failures;
  • Internet outages;
  • Cyberattacks;
  • Government actions;
  • Labor disputes.

21. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

22. Dispute Resolution

The parties agree to attempt to resolve disputes through good-faith negotiations before initiating formal proceedings.

Where appropriate, disputes may be referred to mediation or arbitration.

23. Changes to These Terms

Updated versions of these Terms will be published on the mirsv.io website.

Continued use of the services constitutes acceptance of the updated Terms.
